General Terms and Conditions (GTC):

  1. Scope

1.1 These General Terms and Conditions apply to all business transactions between Café Felix AG (hereinafter "We") and its customers (hereinafter "Customer") in connection with our café offerings, unless otherwise agreed in writing.
1.2 Conflicting or supplementary terms and conditions of the customer are only binding if we have expressly confirmed their validity in writing.

  1. Services

2.1 We operate a café at Bellevueplatz 5 in Zurich and offer catering services (food, beverages, seating) as well as event offers or catering services, if applicable.
2.2 The scope, content and prices of the services are set out in our current menu and drinks menu, event brochure or individual agreement.

  1. Reservations and Catering

3.1 Reservations can be made by phone, email, or through our website. When making a reservation, we recommend paying a deposit or making a prior arrangement, especially for larger events.
3.2 For catering services, the terms and conditions agreed between us and the customer also apply (e.g. minimum order value, delivery time, personnel, equipment, and, if applicable, setup/dismantling).
3.3 In the event of a no-show without timely cancellation, we reserve the right to charge a no-show fee. The amount will be determined individually depending on the event and communicated to the customer in advance.

  1. Prices / Payment

4.1 Our prices are in Swiss francs (CHF), including statutory VAT, where applicable.
4.2 Payments are due immediately unless otherwise agreed for the service. For events/catering, we reserve the right to request a deposit or advance payment.
4.3 In the event of late payment, we reserve the right to charge default interest and reminder fees at the legally permissible rate.

  1. Withdrawal / cancellation

5.1 For individually agreed services (e.g., events, catering), the cancellation or withdrawal conditions agreed in the contract apply. Unless otherwise agreed, the following applies:
• Up to 14 days before the event date: free of charge
• 13-7 days before the event date: 50% of the agreed price
• Less than 7 days before the event date: 100% of the agreed price
5.2 For reservations during "normal café operations," cancellations must be made at least 24 hours in advance. For later cancellations, we reserve the right to charge a cancellation fee (e.g., cover charge or minimum purchase) if we are affected by operational reasons.

  1. Warranty / Liability

6.1 We warrant that our services will be provided in accordance with the contract. Obvious defects must be reported in writing by the customer immediately, and hidden defects must be reported within 7 days of discovery.
6.2 Our liability for slight negligence and indirect damages (in particular, lost profits) is excluded. In cases of willful intent or gross negligence, we are liable in accordance with statutory provisions.
6.3 The customer is obligated to comply with our house rules and regulations during their stay or the event. Any damage caused by the customer or their companions will be the customer's responsibility.

  1. Retention of title

If we provide goods (e.g. in the case of catering), these remain our property until full payment has been made.

  1. Data protection

We process personal data in accordance with our privacy policy (see section 2) and comply with legal requirements.

  1. Place of performance / place of jurisdiction / applicable law

9.1 The place of performance is the registered office of Café Felix AG.
9.2 The place of jurisdiction is – to the extent permitted by law – the registered office of Café Felix AG (Zurich).
9.3 Swiss law shall apply exclusively.

  1. Final provisions

10.1 Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected.
10.2 Any amendments or additions to these Terms and Conditions must be made in writing. Oral ancillary agreements are not valid unless expressly confirmed.
